1. Introduction and Intermediary Status

PropertyPass (the "Platform," "We," "Us") is an online technology service owned and operated by, based in Varanasi, Uttar Pradesh. The Platform provides a document verification and trust-building tool for the real estate sector. By using the website (propertypass.in) or any associated services, including scanning QR codes, you ("User," "Agent," "Buyer") agree to be bound by these Terms and Conditions.

IMPORTANT:

PropertyPass is an INTERMEDIARY under Section 2(1)(w) of the Information Technology Act, 2000. We do not own, sell, or lease any property listed on the platform. We do not act as a real estate agent, broker, or legal representative. Our "Verified" badge and "Trust Score" are based solely on the documents provided by third-party Agents and are for informational purposes only.

2. Agent Responsibilities and Document Authenticity

Agents who sign up and add listings to the Platform represent and warrant that:

They have the legal authority and express consent from the property owner to list the property and share all associated documents (Sale Deed, Khata, etc.).
All documents uploaded are authentic, unaltered, and genuine. Uploading forged or falsified documents is a material breach of these terms and will result in immediate account termination and reporting to the Varanasi Police and UP-RERA.
They are solely responsible for the accuracy of property details, including carpet area, location, and price.

3. The "Verified" Badge and Trust Score Disclaimer

The "Verified" badge indicates that the Platform has completed a procedural check to confirm the existence and apparent validity of the uploaded documents.

NO WARRANTY OF TITLE:

The "Verified" badge is NOT a certificate of legal title, an encumbrance-free guarantee, or a substitute for independent legal due diligence.

98% ACCURACY CLAIM:

The 98% accuracy score is a statistical representation of our document verification process and does not imply a 100% guarantee of property safety. PropertyPass is not liable for the 2% margin of error or for any undisclosed legal defects, such as hidden family disputes or court stay orders.

ADVISORY NATURE:

The "Trust Score" is an opinion generated by a proprietary algorithm and is provided "AS IS." Users are advised to hire legal counsel and conduct a manual search at the Sub-Registrar's office before any financial transaction.

4. QR Code License and Physical Board Usage

PropertyPass grants Agents a non-exclusive, revocable, non-transferable license to use the generated QR codes for the duration of an active subscription.

CUSTODIANSHIP:

The Agent is the custodian of any physical signage or stickers displaying the QR code. The Platform is not liable for losses arising from physical tampering, sticker replacement, or "Quishing" attacks on property sites.

REMOVAL UPON EXPIRY:

Agents must remove all physical stickers and signage within 48 hours of subscription expiry or listing deactivation. Continued display of a deactivated QR code constitutes a misleading advertisement.

5. Limitation of Liability and Indemnity

To the maximum extent permitted by law, PropertyPass shall not be liable for any direct, indirect, incidental, or consequential damages resulting from:

Reliance on the "Verified" badge or Trust Score.
Fraudulent representation by an Agent or third party.
Financial losses in property transactions, including loss of token advances.
Any data breach caused by factors beyond our reasonable security safeguards.

INDEMNITY:

The Agent agrees to indemnify and hold harmless PropertyPass and its directors from any claims, legal fees, or penalties arising from the Agent's submission of fraudulent documents or unauthorized use of the Platform.

6. Governing Law and Varanasi Jurisdiction

These terms are governed by the laws of India. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the Courts of Varanasi, Uttar Pradesh.
